Basha: Architecture of Judicial System Must Be Simplified

The opposition leader Lulzim Basha said that the opposition has complete and rational proposals for unresolved political issues regarding the judicial reform draft. This comment was made after Wednesday’s meeting of the Democratic Party.

“Our draft gives the most complete and rational solution to all the outstanding issues, which have been created because of the lack of dialogue between the two sides, a dialogue which I hope will not be postponed. The DP has expressed its clear will for the creation of the special structure of the National Bureau of Investigation and the process for the verification of the figure of judges. Our draft is consolidated and will form the basis of our negotiations with the SP and SMI,” democrat Basha said.

When asked about the architecture of the judicial system, which the Socialist Party (SP) says that it cannot be touched, Basha had a different opinion.

“The Venice Commission has said that the system is very complicated and there is doubt if it can stand ‘as is’, and if Albania has the necessary capacity to keep it ‘as is.’ After this, it says that they met Fatmir Xhafa and Fatmir Xhafa assured them that Albania has enough people for the system to stand ‘as is’ and we are prepared to accept such a system, if the two sides agree. But now, if Fatmir Xhafa has said that we have 12 people that we can pay as much as we pay the President of Republic, and seven others who will be paid twice as much as the PM to be the judges of judges, at a time when in the last 25 years it has been so hard to just find the right members for the Constitutional Court and the High Court, then it’s a no-brainer to understand that Albania does not have these capacities. Where are these 12 figures and 7 pioneers to undertake this?” Mr. Basha said.

Further on, the opposition leader said that the architecture of the judicial system can be simplified.

“The architecture of the judicial system can and should be simplified to serve the system and citizens. We make proposals which serve the citizens. Our goal is not to find a job for people like Sokol Sadushi, Genti Ibrahimi, Ardian Dvorani, Kristaq Traja, Fatmir Xhafa, or even Enkelejd Alibeaj, if he aspires to be such. If that would be the goal, we could find a job for 19 people who get paid Lek6 million per month, but this would not be a judicial reform. The DP wants to give the Albanians a judicial system which works, not a judicial system which hires political people and gives them fat salaries. We want a non-partisan system, not a bi-partisan one,” democrat Basha said.
