Elvis Roshi Demands Mandates’ Restoration

Former Kavaja Mayor, Elvis Roshi complaint against Central Election Commission (CEC) will be examined tomorrow by the Constitutional Court. Roshi demands the CEC and executive’s decision for his dismissal abrogation due to the incongruity with the constitution. 

His complaint was submitted to the Constitutional Court on Monday by his lawyer, Theodhori Sollaku.

“This request is related to the decision-making process of these institutions that urged the executive to approve the Kavaja mayor dismissal. This decision was mostly connected to the CEC procedures. This institution failed to fulfill a legal obligation, the administration of the file that included courts’ final verdicts on Roshi. On the other side the former-mayor of Kavaja and his lawyer submitted a number of official documents issued by the foreign authorities proving that he has no criminal records. 

We have also objected the executive’s decision due to its incongruity with the European Convention on Human Rights (ECHR) and the country’s constitution. We argue that the sanctions foreseen by the decriminalization law are of course penal and can’t have any retroactive power,” declared Sollaku speaking to the journalists.

Roshi was among the first elected officials that experienced the decriminalization law consequences. He was strip off his mandate by the CEC acting on a request submitted by the Prosecution General. According to the prosecution Roshi concealed some data over a previous conviction for gang rape in Italy in the self-declaration form presented in accordance to this law.
